IMPORTANT NOTICE

By using the Bodylytic website or booking any service, you agree to these Terms and Conditions in full. If you do not agree, please do not use this website or book a service.

1. ABOUT US

Bodylytic Pty Ltd (ABN 72 699 322 980) operates from Sydney CBD, NSW, Australia. We provide non-invasive body contouring treatments including Emerald Laser fat loss therapy. References to "we," "us," and "our" throughout these Terms mean Bodylytic.

2. USE OF THIS WEBSITE

This website is for personal, non-commercial use. You must not use it to:

  • Reproduce, republish, or redistribute any content without our written consent

  • Submit false, misleading, or fraudulent information

  • Engage in any activity that could harm, disrupt, or interfere with the website

  • Attempt to gain unauthorised access to any part of the site or its systems

  • We reserve the right to restrict or terminate access to the website at any time, without notice.

3. SERVICES

Bodylytic offers non-invasive body contouring and aesthetic services. All services are subject to a pre-treatment consultation and suitability assessment. We reserve the right to decline, postpone, or discontinue any treatment where we determine it is not appropriate, safe, or clinically suitable for you.

Our services are cosmetic in nature and are not medical procedures. Bodylytic is not a medical practice, and our staff are not medical practitioners. Nothing on this website or provided by our team constitutes medical advice, diagnosis, or treatment.

4. BOOKINGS & PAYMENT

Bookings are confirmed only upon receipt of full payment or the required deposit as specified at the time of booking.

Bodylytic accepts payment by approved payment methods and may offer third-party payment plans through Klarna or other finance providers from time to time.

Approval for finance is determined solely by the finance provider. Bodylytic has no control over, and accepts no responsibility for, the provider's lending decisions.

Where a client has paid a deposit and their finance application through Klara is declined, Bodylytic will refund the deposit less any non-refundable payment processing fees or reasonable administrative costs incurred by Bodylytic, provided written evidence of the declined application is supplied within seven (7) days of notification.

Where finance is approved, the client remains bound by the terms and conditions of their agreement with the finance provider.

Prices are quoted in Australian Dollars (AUD) and include GST unless otherwise stated.

Prices may change without notice. The price confirmed at the time of booking will apply to that booking.

5. APPOINTMENTS, CANCELLATIONS & NO SHOWS

Appointments may be cancelled or rescheduled without charge where at least twenty-four (24) hours' notice is provided.

Where less than twenty-four (24) hours' notice is given, or where a client fails to attend their appointment without notice, the scheduled treatment session will be forfeited and deducted from the client's treatment package.

For clients paying per treatment rather than under a package, the full treatment fee will be payable.

Late arrival may reduce the available treatment time or require the appointment to be rescheduled.

Bodylytic reserves the right to waive cancellation fees in exceptional circumstances at its sole discretion.

6. AUSTRALIAN CONSUMER LAW

Our services come with guarantees that cannot be excluded under the Australian Consumer Law (ACL). You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have services re-supplied if they fail to meet acceptable quality standards and the failure does not amount to a major failure.

Nothing in these Terms limits, excludes, or modifies any consumer guarantee, right, or remedy you have under the Australian Consumer Law that cannot lawfully be excluded.

7. TREATMENT PACKAGES & REFUNDS

Treatment packages are purchased as a series of treatments designed to achieve the best possible clinical outcome.

Once treatment has commenced, treatment packages are generally non-refundable except where required under the Australian Consumer Law.

A decision to change your mind, relocate, or discontinue treatment does not automatically entitle you to a refund.

Treatment packages are valid for twelve (12) months from the date of purchase unless otherwise agreed in writing.

8. MEDICAL DISCLOSURE & CLIENT RESPONSIBILITIES

Clients are responsible for providing complete and accurate information regarding their medical history, medications, allergies, pregnancy status, implanted medical devices, and any other information relevant to treatment.

Failure to disclose relevant medical information may affect treatment suitability and Bodylytic accepts no responsibility for any adverse outcomes arising from incomplete or inaccurate disclosure.

Clients must notify Bodylytic prior to each treatment of any changes to their health, medications, or medical circumstances.

Bodylytic reserves the right to postpone, decline, or discontinue treatment where we believe, in our professional judgement, that treatment may not be appropriate or that medical supervision is advisable.

Where appropriate, we may recommend that a client seeks assessment from their treating medical practitioner or a doctor-led clinic before commencing or continuing treatment. Treatment may be deferred until suitable medical clearance has been obtained.

This policy is intended to protect the health and safety of our clients and does not constitute medical advice or a medical diagnosis.

9. CHANGES IN HEALTH

If a client's health changes in a way that makes treatment unsuitable or unsafe, Bodylytic may postpone or discontinue treatment in the interests of client safety.

Where treatment cannot continue due to a significant medical condition, Bodylytic may, at its discretion, offer an extension of the treatment package, a credit for the remaining unused treatments, or a partial refund for unused treatments after deducting the value of services already provided and any reasonable administrative costs.

Each request will be considered individually, taking into account the client's circumstances.

10. TREATMENT RESULTS

Individual treatment results vary significantly depending on factors including metabolism, age, body composition, hormonal status, medical history, adherence to recommended nutrition and lifestyle advice, and attendance at scheduled treatments.

While Emerald Laser technology is supported by clinical research, Bodylytic cannot guarantee any particular outcome for an individual client.

Any before-and-after photographs, testimonials, or case studies displayed on our website or social media represent the experience of individual clients and should not be interpreted as a guarantee of results.

For optimal clinical outcomes, treatments should be attended at the intervals recommended by Bodylytic. Extended delays between treatments may reduce treatment effectiveness, and Bodylytic accepts no responsibility for diminished results where delays occur due to client choice or failure to attend scheduled appointments.

11. CLINICAL PHOTOGRAPHS

Bodylytic may take clinical photographs before, during, and after treatment for the purpose of monitoring treatment progress and maintaining accurate clinical records.

No photographs will be used for marketing, advertising, or promotional purposes without the client's separate written consent.

12. CLIENT CONDUCT

Bodylytic is committed to providing a safe and respectful environment for both clients and staff.

We reserve the right to refuse or discontinue treatment where a client behaves in an abusive, aggressive, threatening, intoxicated, or otherwise inappropriate manner.

13. INTELLECTUAL PROPERTY

All content on this website, including text, graphics, logos, photographs, branding, videos, documents, and other materials, is owned by or licensed to Bodylytic and is protected by Australian intellectual property laws.

You may not copy, reproduce, distribute, modify, or otherwise use any content without our prior written consent.

14. THIRD PARTY LINKS

This website may contain links to third-party websites for your convenience. Bodylytic does not endorse and is not responsible for the content, privacy practices, products, or services offered by those third-party websites.

15. LIMITATION OF LIABILITY

To the maximum extent permitted by law, Bodylytic and its directors, employees, contractors, and representatives are not liable for any direct, indirect, incidental, special, or consequential loss or damage arising from your use of this website or our services, except where liability cannot be excluded under the Australian Consumer Law.

16. FORCE MAJEURE

Bodylytic shall not be liable for any delay, cancellation, or inability to provide services resulting from circumstances beyond our reasonable control, including but not limited to equipment failure, power outages, natural disasters, government restrictions, pandemics, or other unforeseen events.

17. GOVERNING LAW

These Terms are governed by the laws of New South Wales, Australia.

Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the courts of New South Wales.

18. CHANGES TO THESE TERMS

Bodylytic reserves the right to amend these Terms and Conditions at any time.

Any updated version will be published on our website. Continued use of our website or booking of our services after changes are published constitutes acceptance of the revised Terms.
